As per The Constitution of India, (97th Amendment) Act, 2011, Article 243ZK, the superintendence, direction and control of the preparation of electoral
rolls for, and the conduct of, all elections of a co-operative society in the state, shall vest in such an authority or body, as may be provided by the
legislature of a State.
Accordingly, Maharashtra Co-operative Societies Act, 1960 was amended providing for the establishment of a State Cooperative Election Authority in the State.
In terms of section 73 CB of Maharashtra Cooperative Act 1960 (Mah. XXIV of 1961), the State Government is expected to constitute State Cooperative Election
Authority consisting of a Co-operative Election Commissioner. Accordingly, the State Cooperative Election Authority has been constituted vide Gazette
Notification no. CSL-2013/C.R.124/15-C, dated 30/03/2013. The State Co-operative Election Authority (SCEA) is a statutory body responsible for superintendence,
direction and control of the preparation of the electoral rolls for, and the conduct of, all elections to the Co-operative Societies in the State, according
to the rules & regulations framed by State Government. In Writ petition no.12321/2015 with 11049/2015, the Hon’ble Bombay High Court has also clarified that
the SCEA is an Autonomus, Independend and impartial authority.
The elections of cooperative Housing societies having 250 members or less than that are to be conducted by the society itself. Hence these elections
are not conducted by State Cooperative Election Authority.
The State Cooperative Election Authority, M.S. Pune is also vested with the powers to conduct the elections of the Agricultural Produce Market Committees
(APMC) in the state vide Gazette Notification no. KPM.0817/C.R.164/21-C (2), dated 18.12.2017.
For the purpose of conduct of election to societies, the societies are classified in to Type “A”, Type “B”, Type “C” and Type “D” societies as prescribed in
election rules.
The State Cooperative Election Authority has its office at Pune. The District Cooperative Election Officers and Taluka/Ward cooperative Election Officers
have been appointed By SCEA, for respective jurisdiction.
